Moses v. Stephens

Supreme Court of Van Diemen’s Land

Pedder C.J. and Montagu J., in Banco, 15 May 1840

Source: Hobart Town Courier, 22 May 1840

This was a motion to discharge the defendant, a married woman, who had given a warrant of attorney upon which she had been sued and put in gaol.

The Attorney General and Mr. Rowlands objected to the shortness of notice given, and applied for further time.

Their Honors considered that as the woman was in gaol, they ought not to give further time, and no cause being shown ordered her to be discharged with costs.
