LAW203 Torts - 3 credit points
This unit examines the law of torts from a theoretical and normative perspective, focusing in particular on the relationship between social and legal change. The work in this unit builds on and extends knowledge and skills gained in LAW104, LAW114 and LAW204. Torts is an area of law which addresses the question of social responsibility between members of a community. We examine the philosophical foundations of fault and responsibility, and begin to consider the aims, purposes and rationale of the law of Torts. The main focus of the unit is on the law of negligence, the most sigmificant of the modern torts. Judicial developmeht of the law of negligence raises historical, ethical, moral, philosophical, constitutional and political issues. Other topics discussed include intention torts, nuisance, concurrent liability and defences.
