Profile

Dat Tien Bui is a lecturer at the Law School, Vietnam National University Hanoi; and a PhD candidate at Macquarie Law School, Macquarie University. In 2012, Dat Tien Bui won a PhD Australian Award to undertake research at the Macquarie Law School. He has won a Macquarie University Postgraduate Research Grant to attend a visiting research programme at the Norwegian Centre of Human Rights, University of Oslo in May 2016.

Title

"The Limitation on Fair Trial Rights in Summary Criminal Processes: Implications for Vietnam from the Experiences of England and Wales"

Overview

Minor offences account for a vast majority of criminal cases and enjoy a poor protection of procedural rights. The extent to which fair trial rights can be limited in dealing with these offences is controversial and has not been examined rigorously. This thesis is a comparative study between the United Kingdom and Vietnam, which differ in traditions of procedural protection but seem to converge in some aspects. The thesis develops reasoning in assessing procedural rights limitations for minor offences and argues for a rigorous application of proportionality doctrine and procedural fairness for Vietnam's minor offence processes reform.
